Article 2: These measures apply to safety evaluation agencies and personnel operating within the administrative region of Guangdong Province who conduct statutory safety assessments. They also apply to safety production supervision departments that implement qualification management for safety evaluation institutions. Foreign institutions applying for safety evaluation qualifications must follow national regulations. Article 3: Safety evaluation agencies are subject to a qualification management system. Only those with valid qualification certificates may carry out safety evaluation work within their designated scope. Personnel conducting safety evaluations must hold appropriate qualifications. Agencies or individuals without valid certifications are prohibited from engaging in such activities. Article 4: The qualifications for safety evaluation agencies are divided into two levels: A and B. Grade A qualifications are issued by the State Administration of Work Safety, while Grade B qualifications are issued by the Guangdong Provincial Safety Production Supervision Administration. Article 5: The business scope of Grade B safety evaluation agencies is determined according to the "General Standard for Safety Evaluation (AQ8001-2007)" issued by the State Administration of Work Safety. If new provisions are issued, they will take precedence. Article 6: Grade B safety evaluation agencies may conduct pre-evaluations, acceptance assessments, and safety status assessments for construction projects with an investment of up to 200 million yuan. Projects exceeding this limit must follow national regulations. **Chapter II: Application Conditions and Approval Procedures** Article 7: To apply for a Grade B qualification certificate, agencies must meet the following conditions: (1) Have independent legal status; (2) Possess suitable office space (at least 150 square meters); (3) Have registered capital of over 1 million yuan; (4) Maintain a sound management system and technical support; (5) Employ at least 8 full-time qualified safety evaluators, including at least 2 with senior titles or registered safety engineers; (6) Sign labor contracts with all evaluators; (7) Ensure the legal representative has proper qualifications and experience; (8) Appoint a full-time technical director with relevant professional experience; (9) Meet the basic requirements for professional evaluators; (10) Pass the provincial bureau’s examination; (11) Comply with other legal requirements. Article 8: The application process involves submitting forms and documents to the Provincial Safety Supervision Bureau. The bureau reviews applications within 20 days and issues or denies the certificate accordingly. Article 9: Out-of-province Grade A agencies operating in Guangdong must inform the local safety supervision department and submit their qualification and business license copies. Article 10: Grade B certificates are valid for 3 years. Extensions must be applied for 3 months before expiration. Article 11: Changes in agency structure, legal representatives, or closure require formal procedures. **Chapter III: Safety Evaluation Organizations and Evaluators** Article 12: Agencies must conduct assessments independently, follow guidelines, and bear legal responsibility for their results. Article 13: Assessments must be conducted within the approved scope, and contracts must be signed with clients. Article 14: Fees must comply with regulations or industry standards. Article 15: Evaluators must maintain ethical standards, avoid conflicts of interest, and only practice in one institution. Article 16: Agencies and personnel must cooperate with inspections and follow state guidelines. Article 17: Annual performance records must be submitted for review. Article 18: Agencies must enhance technical capabilities and ensure high-quality assessments. **Chapter IV: Supervision and Management** Article 19: Authorities must operate transparently and publish lists of certified agencies. Article 20: Officials must not interfere with agency operations or charge illegal fees. Article 21: Local authorities must inspect and supervise agencies, using peer reviews and random checks. Article 22: The Provincial Bureau conducts regular assessments of Grade B agencies based on established criteria. Article 23: Agencies found violating rules will face penalties, including fines or revocation of licenses. Article 24: Anyone can report violations, and authorities must investigate and protect informants. Article 25: Violations of these measures will be punished under relevant laws and regulations. **Chapter V: Supplementary Provisions** Article 26: The Guangdong Provincial Bureau of Safety Production Supervision interprets these measures.
